These terms and conditions regulate the use of the website www.smcosmetology.pt and any commercial transaction carried out through the “SM-Cosmetology” online store and its users (hereinafter referred to as the customer).



Purpose

The purpose of these terms and conditions is to define the terms of sale between SM-Cosmetology and the customer, from the order to the services, including payment and delivery.



Orders

To place an order, the customer must provide :


- their user code and password
- their delivery details

- billing details

The fact that the customer places an order is tantamount to full acceptance of the prices and description of the products available for sale as well as the general conditions of sale, which will be the only ones applicable to the contract thus concluded.

SM-Cosmetology will honor orders received online only up to the limit of available stocks. If the product is not available, “SM-Cosmetology” undertakes to inform the customer as soon as possible.

If the order is canceled at the customer's request, “SM-Cosmetology” will issue a refund as soon as possible, with a maximum refund period of 14 working days.

The refund will be credited upon arrival of the product, to the same place of payment and a confirmation e-mail will be sent to the customer.

 

Delivery

Orders will be delivered to the address indicated by the customer when placing the order. Delivery costs and times will be communicated to the customer at the time of placing the order. By placing an order, the customer accepts these costs and delivery times. When placing an order, the customer must make sure that they indicate an address where someone is usually located, as we are unable to indicate the estimated time of delivery.

The shipping costs accepted by the customer at the time of purchase correspond to a service provided by “SM-Cosmetology” or its distribution partners and are only intended to deliver the order from point A (“SM-Cosmetology” premises) to point B (address indicated by the customer).

To follow up an order in progress, the customer can and should contact the Customer Service of the corresponding distribution partners. Before the order is dispatched, an email is sent to the customer with the details for tracking their order.

 

Payment

On the website www.smcosmetology.pt, “SM-Cosmetology” offers customers various payment methods:

- Bank transfer

- ATM reference

- MbWay

- Paypal

- Credit card

In the case of payment by credit card, the charge will be made when the purchase is confirmed.

SM-Cosmetology does not have access to its customers' payment details and will make every effort to guarantee the utmost confidentiality and security of data transmitted over the Internet.

 

Exchanges and returns

The exchange or return of products purchased on the “SM-Cosmetology” website must be communicated in writing to info@smcosmetology.pt within 14 days of placing the order.

Some products cannot be returned or refunded for hygiene and health reasons.

Products returned for a refund must be in the same condition as they were sent to the customer, without any damage or anomalies, sealed and in their original packaging. We recommend that returns be made by registered mail. Shipping costs are non-refundable.

If the customer receives a product that does not correspond to the one purchased or if the product received is damaged, “SM-Cosmetology” will refund the shipping cost upon receipt.

For orders outside Portugal, the refund amount may vary according to the current exchange rate and the conditions will be indicated and defined by “SM-Cosmetology”.

The refund will be credited upon arrival of the product, to the same place of payment and a confirmation email will be sent to the customer.

 

Products not sent

In the event that the customer receives an order with missing product(s), the customer has 8 days from the date of receipt of the order to report this.



Liability

SM-Cosmetology excludes all guarantees and any liability for inconveniences or damages inherent in the use of the Internet network, in particular, a disruption of service, external intrusion or the presence of computer viruses, or any case of force majeure so classified by the jurisprudence of the courts, to the extent permitted by applicable law.

 

Processing of Personal Data

The customer authorizes “SM-Cosmetology” to automatically process the personal data provided by the purchase order, in particular by using cookies. If the password is lost or forgotten, the customer can start the password recovery process in the “Recover Password” section.



SM-Cosmetology" Newsletter

The “SM-Cosmetology” Newsletter is the name given to e-mails with promotions, offers and information sent directly to the customer's e-mail inbox.
The customer is automatically registered as soon as they register with “SM-Cosmetology”.


Entire Agreement

These Conditions of Sale constitute the entire agreement between the parties concerned.

In the event that any of the clauses of this contract is declared null and void, by virtue of a legislative or regulatory change or by judgment, it shall not lose its validity and compliance with these General Conditions of Sale shall be mandatory.

SM-Cosmetology reserves the right to amend these Terms and Conditions at any time.


Keeping and archiving transactions

Orders and invoices will be stored on a reliable and durable medium in order to provide a faithful and lasting copy.


Applicable Law and Jurisdiction

Portuguese law shall apply to the terms of this contract. The attribution of jurisdiction in the event of a dispute, and in the absence of an amicable agreement between the parties, shall be submitted to the competent courts of Portugal despite the plurality of defendants and/or whatever the type of proceedings.

In the event of a dispute, the consumer, under Law No. 144/2015, may also resort to an Alternative Dispute Resolution Body: CNIACC - Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.arbitragemdeconsumo.org).
